CONSENT TO PROCESSING OF PERSONAL DATA
DURING USE OF ID1 PRODUCTS AND SERVICES
As part of my subscription to products and services (hereafter the “” PRODUCTS “”) on offer from Phosphorescence (hereafter “”ID1“”) :
– I promise to use the PRODUCTS in normal conditions and to respect the instructions for use, care and safety outlined in the General Terms & Conditions and in the related documents.
– I recognise I have carefully read the General Terms & Conditions and the documents provided with the PRODUCTS and, in consequence, any incorrect use of the service will be my full responsibility.
– I have been informed and agree to my personal health data being processed by ID1 as the provider of the products and services, in the following way:
Collection and aims of data processing :
I have been informed that my private data can be collected :
– when my customer account is set up,
– when an order is made on the website or from a distributor,
– via the contact forms on the website, and/or
– when I complete the following sections of my customer account : “” Information “”, “” Health data “”, “” Professionals “” and “” Medical files “” to create an emergency profile and/or a medical file.
I have been informed that these data are digitally processed with the aim of:
– Creating a customer account. A customer account can only be created after my personaldata have been communicated. As a result, failure to communicate data will preventthe customer account from being set up and any use of the services.
– Carrying out services. Access to services will be conditioned on the User and/or beneficiary and/or Beneficiary communicating data of a personal nature. Failure to communicate these data will prevent access to the services.
– Management of my requests as stated in the contact form. Processing data of a personal nature will condition reception of the request la . Failure to communicate these data will prevent the request from being sent.
– Making sure my emergency profile and/or my medical file is accessible. Failure to communicate this information will prevent access to the emergency profile and/or the complete medical file and will prevent the product concerned and my subscription from functioning correctly.
Recipients of data:
I have been informed that ID1 may transmit:
– my payment details, to the Braintree company to process payment (www.braintreepayments.com) ;
– the data relating to my contact details, to third parties with whom the company sub-contracts delivery of the PRODUCTS ordered and/or where relevant , communication of information and promotional and sales offers;
– the data completed in the various sections of my customer account (“” Information “”, “” Health data “”, “” Professionals “” and “” Medical files “”) for COREYE the company to which ID1 sub-contracts hosting, managing, , safeguarding and conserving data (www.coreye.fr), health professionals and the person tocontact in an emergency situation presenting a risk for my health.
For this reason, I am informed that the COREYE company is authorised by the Ministry of Health , in application of the provisions of article L.1111-8 of the Public Health Code and the decree n°2006-6 of 4 January 2006 relating to hosting of health data of a personal nature.
Duration of data storage:
I have been informed that, subject to a specific legal or regulatory obligation imposing longer duration of data-conservation , ID1 will only conserve my data for the following time:
– Data collected when my customer account was set up: Maximum duration of 3 years after the date of the last purchase and/or exchanges
– Data collected to carry out the service: Time needed to carry out the service and respond to any complaints
– Data collected to send out information and sales and promotional offers by ID1 (e-mail, telephone and postal address, where relevant): Maximum duration of 3 years after the date of the last purchase and/or exchanges
– Data in sections of my customer account (“” Information””, “”Health data””, “”Professionals”” and “”Medical files””) : Duration of chosen subscription and renewal (except for dataI have deleted)
My rights :
I have been informed that, in compliance with the applicable regulations concerning personal data protection (resulting in particular from the General Data Protection Regulation in force since 25 May 2018 and of the Data Protection Act of 6 January 1978, modified by the law of 20 June 2018), I have:
– a right to access, rectify, delete and transfer my data,
– a right to limit processing of my data,
– a right to oppose processing of my data,
– a right to define the directives relating to the use of my data after my death,
– a right not to be subject to profiling measures,
– a right to withdraw my consent at any time to processing based on the collection of my data, that I can be carried out in.
